What is the Regime of Acquired Property?

 

The regime of acquired property is the statutory matrimonial property regime in Switzerland. It is defined in Art. 196ff in the Swiss Civil code and applies unless determined otherwise through a contract. Under the regime of acquired property, the spouses have no shared property. For the duration of a marriage, the regime of acquired property is thus no different from separation of property.

 

 

When does the Regime of Acquired Property become relevant?

The difference between the regime of acquired property and separation of property only becomes relevant upon death, divorce, change to a different matrimonial property regime, etc. At that point, the acquired property of the two spouses (but not the individual property) are subject to equal division.
